discretion. Any user ID and password you may have for this website are confidential,  and you must maintain confidentiality as well.

Tuition Refund & Cancellation Policy

This is a legally binding contract between the Student and the Institution NAPTP 28050  Ford Rd. Ste B Garden City, MI.. The Student understands that they may cancel this  Contract within 72 hours, no later than midnight from the time that the Student signs  this Contract, or checks the box that they agree to terms and conditions on the website.  Students must notify the school via email, or in writing by mail, by sending the Notice of  Cancellation or other written notice to the Institution on or before that date.

There will be absolutely no refunds after the start of the first day of a program,  regardless of refund/cancellation period or if student has already accessed the online  materials such as taken a quiz or test.

An application fee of not more than $75.00 will be retained by the Institution upon  students request for refund within the allotted 72 hour period. Furthermore, student  acknowledges that they are responsible for the entire cost of the class if they fail to  make the payments as agreed upon during their registration process and are dismissed  due to non payment.

Student ConductThe Student must apply his or her reasonable efforts to prepare for  each class, attend each class (on time), and apply him or herself to the best of the  Student’s ability to learn the subject matter of the class or Program the Student has  signed up for. The Student must fulfill the expectation of completing the class or  Program within the term determined by the Institution. Students understand that the  terms may be extended, held or changed at the discretion of the Institution. The Student  will comply with and be subject to the following policies of the Institution as stated  below: Dress Code; Academic Dishonesty; Grading System; Attendance, Tardiness and  Absences; Rules of Conduct; and Security Camera. The Student has reviewed each such  Policy as published in the Institution’s Catalog, Course Curriculum, or at its Web  Site. The Student understands that the Institution may take adverse action against the  Student in the event he/she violates any such Policy. Such adverse action may be up to  and including dismissal from the Program without a refund of Tuition.

NAPTP Student Anti-Bullying & Harassment Policy

The purpose of this policy is to communicate to all students, and including instructors,  administrators and executives, that NAPTP will not in any instance tolerate bullying or  harassment behavior. Students found in violation of this policy will be disciplined, up to  and including expulsion. This applies to phone calls, text messages, emails and mail  that is corresponded from the student to the staff at NAPTP.

NAPTP defines bullying as repeated, health-harming mistreatment of one or more  people by one or more perpetrators.

It is abusive conduct that includes:

Threatening, humiliating or intimidating behaviors.

Work interference/sabotage that prevents work from getting done. Verbal, physical, and mental abuse of any kind.

NAPTP considers the following types of behavior examples of bullying:

Verbal bullying: Slandering, ridiculing or badmouthing a person or his or her family;  persistent name-calling that is hurtful, insulting or humiliating; using a person as the  butt of jokes; abusive and offensive remarks, insubordination, shouting or raising one’s  voice to insinuate intimidation or violence.

Physical bullying: Pushing, shoving, kicking, poking, tripping, assault or threat of  physical assault, damage to a person’s work area or property.

Gesture bullying: Nonverbal gestures that can convey threatening messages such as  punching the air behind someone’s back or putting a finger or finger gun to one’s throat.

Exclusion: Socially or physically excluding or disregarding a person in work-related  activities.

In addition, the following examples may constitute or contribute to evidence of bullying  in the workplace:

Persistent singling out of one person.

Shouting or raising one’s voice at an individual in public or in private. Using obscene or intimidating gestures.

Not allowing the person to speak or express himself of herself (i.e., ignoring or  interrupting).

Personal insults and use of offensive nicknames.

Public humiliation in any form.

Constant criticism on matters unrelated or minimally related to the person’s job  performance or description.

Public reprimands.

Repeatedly accusing someone of errors that cannot be documented.

Deliberately interfering with mail and other communications.

Spreading rumors and gossip regarding individuals.

Slandering an individual.

Encouraging others to disregard an administrator or director’s instructions. Manipulating the ability of someone to do his or her work (e.g., overloading,  underloading, withholding information, setting deadlines that cannot be met,  giving deliberately ambiguous instructions).

Assigning menial tasks not in keeping with the normal responsibilities of the job. Taking credit for another person’s ideas.

Refusing reasonable requests for leave in the absence of work-related reasons  not to grant leave.

Deliberately excluding an individual or isolating him or her from work-related  activities, such as meetings.

Unwanted physical contact, physical abuse or threats of abuse to an individual or  an individual’s property (defacing or marking up property).

Individuals who feel they have experienced or witnessed bullying, harassment, or  student misconduct of any kind should report this to NAPTP LLC before the conduct  becomes severe or pervasive. All students are strongly encouraged to report any  bullying conduct they experience or witness as soon as possible to allow NAPTP to take  appropriate action.

School ProgramsThe Institution shall conduct the Programs, classes and clinical  comprising each Program the Student attends in the manner, at the times, and with the  content presented in the Institution’s current Catalog or Course Curriculum. The  Institution reserves the right to modify each Program or Course at any time consistent  with prevailing industry and academic standards. The Institution may substitute  instructors, times or locations or any classes or clinical in its reasonable discretion, and  with reasonable advance notice to Student. The Institution reserves the right to alter,  modify, or cancel Course or Program schedules and other classes. The Institution  presents Programs or Courses in the English language but may offer accommodation  for other languages as presented and available. Tutoring is available and is subject to  pricing and availability.

Distance LearningSome Courses or Programs may be presented in an Internet-based  and/or distance learning format, in whole or part. Students must have their own  computer with Internet access that may be used for such purposes, and can only have  one seat per Student for each such class or Program.

Copyright CopyingAll taping, copying, recording, distribution, reproduction, or  transmittal of all or any syllabi, academic materials, textbooks, lessons, clinics, lectures,  or presentations connected to any Programs, classes or clinical of the Institution is  strictly forbidden without the advance written consent of the Institution.

Non-PaymentIf any Tuition owed by the Student is not paid when owed or is  dishonored, reversed, or declined by a credit card, the Student shall not be eligible to  continue to attend or complete the Program, class or clinical the Student has signed up  for, unless the Student immediately pays the balance due. A Student who fails to pay  Tuition on time shall not be entitled to a refund of any previously paid Tuition, except as  provided in the Refund Policy. A Student whose payment of Tuition has not been made  or has been dishonored, reversed or declined shall be liable for any fees or costs  incurred by the Institution due to any such event, the full amount of Tuition owed by the  Student, plus interest at the highest rate allowed by law.

DisclaimerThe Student acknowledges and understands that his or her success or  outcome from the Institution’s Programs, classes or clinical depends upon the level of  effort, ability and attention the Student brings to and applies in the learning process. No  additional support, training, teaching, or act by or on behalf of the Institution is expressly  promised or implied, beyond the training that is presented as stated in School  Programs above. The Institution makes no express or implied representation as to  Student’s successful application of the knowledge or skills learned from any Programs,  classes or clinicals conducted by the Institution. The Institution may dismiss without  refund any student who does not comply with proper safety protocol, infection control and all other reasonable and legal requests made by the Institution. The Institution does  not provide placement services and does not guarantee or promise that the Student will  achieve any particular outcome from any Program, acquire a job of any kind following  completion of a Program, or that the Student will complete or pass any licensing exam  as a result of attending or completing any Program.

NAPTP Student Policies 

Dress Code; All students must wear their intended uniform color, lab coat, and if  applicable, a badge ID when attending class, blood draws or externships in  representation of NAPTP.

Academic Dishonesty; Any students who are found performing academic dishonesty  will be subject to dismissal or expulsion from the course or program without refund.

Grading System; Students must complete their assigned quizzes and final exams in  order to receive their grades through the online learning system.

Attendance; As these are accelerated courses, Students must attend ALL classes both  online and in-person to receive the full course of education. Students are responsible  for receiving any necessary work from days missed.

Tardiness and Absences; Students will not be permitted to attend class if more than 30  minutes late unless Student has expressly and reasonably stated the reason before  class. Students who are absent more than twice may be expelled from their course with  no refund.

Rules of Conduct; NAPTP will not in any instance tolerate bullying, harassing, or  discriminatory behavior for any student. NAPTP expects all Students to conduct  themselves in the most respectful and professional manner. NAPTP reserves the right  that Students who are found in violation of Conduct may be dismissed or expelled with  no refund.

Security Camera; The NAPTP location in Garden City, MI uses Security Cameras for the  purposes of emergencies, theft, vandalism, and other violations of conduct on the  school campus.

Books and Supplies

You agree that this is a legally binding contract provided within these terms and  conditions and that you are eighteen years of age and have read the below terms of the  book voucher and fully understand the content therein.

You testify that you are the person whose information appears on this book voucher  application and/or credit card and take full responsibility for the purchase of the course  and/or its books. You understand that intentional misrepresentation is illegal and is  punishable by law. Furthermore, you understand that if for any reason you request a  refund, then all supplies and/or books provided will be kept by the student and will not  be eligible for return or refund and will be subtracted from the refunded cost of tuition  along with any shipping or handling costs incurred.

If the Student’s course program included books and/or supplies that must be returned,  then the student shall have 14 days to return all materials after course expiration or  unless stated otherwise by administration. Failure to return any books or supplies will  result in an invoice or bill being emailed and/or mailed to the student’s personal contact  information. Additionally, legal recourse will be taken if the books and/or supplies are  not returned in a timely manner as described above and agree to all legal hearings to be  held in Michigan and waive the right to any legal hearings to be held in my state.

You understand that if the course program does not include books and/or supplies, you  will be responsible for the purchasing of all necessary supplies and/or equipment and  will not hold NAPTP LLC responsible for such purchases.

All students who agree to these terms and conditions attest to the acknowledgement,  competency and agreement to the following terms in context of website material,  books, and supplies:

1. If sharps such as needles, syringes, glass medication practice vials and other  practice medications are included in the course package, you understand that

these are just for practice, that they are not for human consumption, and are not  real medication.

2. You agree that you will not begin to use the contents of the package until you  have watched the necessary online videos and have full understanding on  techniques, handling, biohazardous materials and infection control.

3. You understand that sharps handling may pose a potential risk to health and  should be kept out of reach from other adults, children and animals. You  therefore agree to store the equipment so that no living being can be harmed and  will take full responsibility. You hold NAPTP LLC and its representatives, agents,  heirs and anyone else associated with NAPTP LLC, harmless from any injuries or  disabilities that you, any animal, or any person(s) who may have been around the  equipment may have sustained, either life threatening or otherwise, and will  accept responsibility of all expenses resulting from any emergency care or  hospitalization that may incur as a result of injury with use of said equipment.

4. You understand that you have signed up for this course with the understanding  that you may be using instruments such as needles, syringes, vacutainer holders,  medication vials, practice medication, bp cuff, stethoscope, vacutainer needles,  vacutainer hubs, gloves and gauze, alcohol pads and possibly betadine.

Additionally, the student attests to understand that they will be exposed to visual and  academic representation of such materials in their course content and website material  as well as during any clinical externships, internships, volunteerships and employments  that they may obtain after successful completion of their course program.

Terms of Use

PURPOSE; DEFINITIONS. These Terms of Use govern the use by the Customer (defined  to include all employees, staff, faculty and agents of the Customer) of the NAPTP Products and Services listed on the NAPTP website to which this Terms of Use is  attached NAPTP , and all other Proprietary Materials provided to or obtained by the  Customer. ‘‘Products’’ shall mean the proprietary products of NAPTP or its affiliated  entities (‘‘Affiliates’’), sold through NAPTP as listed on the NAPTP Website and made  available to Customer in any form or medium delivered or made accessible to  Customer, including hard copy and/or online delivery and all copies made thereof, and  all updates and revisions provided by NAPTP, or its Affiliates thereto. ‘‘Services’’ shall  mean any service provided by NAPTP or its Affiliates to the Customer in connection  with Product(s). “Proprietary Materials”

“Proprietary Materials” shall mean all other forms of content created by or on behalf of  NAPTP herein to be called NAPTP or affiliates of NAPTP including but not limited to  reports, publications, white papers, studies, blog posts or other similar materials.

LICENSE GRANT AND RESTRICTIONS FOR ONLINE PRODUCTS AND SERVICES. (a)  Subject to the terms herein and provided that Customer has paid all outstanding

balances due NAPTP or its Affiliates pursuant to any prior agreements, orders or  understandings between the Parties, NAPTP and affiliates grants to Customer a non exclusive, non-transferrable, non-sublicensable right to access and use the Products  and Services delivered or made available online to Customer by NAPTP as described  herein (‘‘General License’’). Such Products and Services may be used only by  Customer’s sponsored certification candidates (each, a ‘‘Candidate’’), administrators,  faculty, and staff in the Territory noted above (collectively, ‘‘Authorized Users’’).  Products are strictly licensed on a per Candidate basis and are not to be (i) shared  among Candidates, (ii) reproduced or copied in whole or in part in any manner by  Customer, including faculty, or any Candidate, (iii) projected for shared viewing or use,  or (iv) made available in any library or electronic learning management system operated  by Customer for use on other than on a per Candidate basis, all of which are material  violations of the General License granted by NAPTP and grounds for immediate  termination of the General License, dismissed from classes without refund and  prohibited from taking any further classes either in class or online (b) Products which  are comprised of certification examinations offered by NAPTP, online materials,  quizzes, exams, certification study materials, and any materials used in classroom or  online are subject to a limited term of use and may be used only in connection with  classroom studies during the dates specified in the students course length or for a time  not greater than 6 months from the date of

Customer is prohibited from offering a Certification for a class, begin a class or school  at anytime from registration up until perpetuity with any of the tools, layout, mission  statement, logistics of business, that in anyway mimics NAPTP offerings, advertising,  materials, certification layout, transcript etc.

To be clear, Customer, student, including its faculty, has no right to access, review, or  otherwise utilize any content contained in any quizzes, exam, Exam Products of NAPTP and its affiliates, before, during or at any time after an examination or course has been  completed inappropriately as mentioned earlier in this agreement and Customer’s rights  to use Course and exam Products are limited. Instructors, employees, students, i.e.  Customer is strictly forbidden from reproducing, copying, recording, summarizing,  making notes concerning or otherwise capturing the content of any course or exam,  lecture, quiz, powerpoint, article, pdf, hard/soft copy books produced by NAPTP and its  affiliates or any Product or any portion thereof in any manner or using any medium, and  from distributing or transferring the content outside of the purpose of NAPTP education  or for personal gain.

CUSTOMER OBLIGATIONS. Customer shall supervise all use of the Products and  Services by Authorized Users and take reasonable measures to allow only Authorized  Users to access the Products consistent with these Terms of Use. Customer shall not  (and take reasonable steps to ensure Authorized Users do not) (i) modify, translate,  disassemble, decompile, or create derivative works of the Products, Services, or any  portion thereof; (ii) copy, reproduce, transfer, loan, rent, lease, distribute, or grant any  access to or rights in any form to Products or remove or obscure any copyright or other

proprietary notice, labels or proprietary marks in any Products or Services; and (iii) allow  any third party any access to the Products or Services not authorized under these  General Terms. All Products and Services are subject to copyright and contain  proprietary and trade secret information belonging to NAPTP and its affiliates stipulate  that and that Customer agrees not to disclose any Product or portion thereof to any  person who is not an Authorized User. If Customer is obtaining online access to  Products or Services hosted on NAPTP or its Affiliates’ servers, Customer, including  Authorized Users, shall receive and utilize access information, such as passwords and  usernames, (‘‘Access Information’’) to permit Product and ServicesCustomer shall  implement reasonable measures to safeguard against improper sharing or  unauthorized use of such Access Information. Customer will maintain the  confidentiality, security and integrity of the Products, placing special security emphasis  on all examination questions and answers. Customer, i.e. student, faculty NAPTP may  terminate the Licenses by written notice (i) with immediate effect if Customer infringes  or misappropriates any Product or Service made available hereunder, including failure  to return exam materials timely, or otherwise breaches any material License provision  contained in these Terms of Use, or (ii) if Customer fails to cure any other material  breach of these terms within thirty (30) days after receipt of written notice from NAPTP.

PROPRIETARY RIGHTS. Customer /student acknowledges that the Products, Services  and Proprietary Materials it receives are the sole and exclusive intellectual property of  NAPTP and its Affiliates, or their respective licensors and are protected by copyright. All  use of NAPTP or its affiliates names, logos or marks must be pre-approved by NAPTP.  All rights are reserved by NAPTP and its No part of the Products, Services or Proprietary  Materials may be copied, reproduced, recorded, distributed, or made public, in whole or  in part, without prior review by, and written consent of, NAPTP. Other than as expressly  set forth in these Terms of Use, no license or other rights in or to the Products, Services  or Proprietary Materials are granted to Customer, and all such licenses and rights are  hereby expressly reserved by NAPTP and its Affiliates. Customer’s limited right to use  the Products, Services and Proprietary Materials is governed by these Terms of Use,  and any terms included in the applicable Products, Services and Proprietary  Materials. NAPTP and its Affiliates reserve the right to seek all legal and equitable  rights and remedies available to them for any Customer violation of these Terms of  Use.If Customer registers with NAPTP or its Affiliates using its online registration or in  person, All NAPTP Orders are subject to these Terms of Customer represents that  Customer is fully authorized to enter into these Terms of Use for orders of online  Products and Services, Order are exclusive of any sales, use, value added or other taxes,  fees, or costs which may be imposed, levied, or assessed against the sale, licensing,  delivery, or use of Product(s) or Services. All prices and fees are expressed in U.S.  dollars. Shipping and handling costs, as well as any tax owed by Customer, will be  added to the purchase amount. Customer shall pay all taxes that may become due as a  result of the NAPTP Order, excepting only NAPTP and its Affiliates’ income and payroll  related taxes. NAPTP shall invoice Customer for all such taxes, which may be paid by  NAPTP or its applicable Affiliates unless, prior to Product delivery or commencement of  applicable Services, Customer provides NAPTP with a valid tax-exempt certificate. No

returns shall be accepted on Products delivered hereunder.NAPTP and its affiliates  reserves the right to adjust its pricing at any time, such price changes to be posted on  NAPTP and its affiliates website at www.phlebotomycareertraining.com. 

MISCELLANEOUS: These terms may not be modified except by a written amendment  signed by an authorized representative of Customer/student and NAPTP and or its  Customer may not assign any of its rights or obligations herein.

These Terms of Use are governed by the laws of the State of Michigan.

No warranty of merchantability or fitness for a particular purpose is promised, express  or implied, with respect to any Product or Service, Institution and Research.

In connection with any federal contracts, the online Products and Services and  Proprietary Materials were developed solely at private expense, contain “restricted  computer software” submitted with restricted rights in accordance with the US FAR  52.227-19 (a) through (c) of the Commercial Computer Software License (Dec 2007)  Clause and its successors, and in all respects is proprietary data belonging to NAPTP and its Affiliates.

VIDEO/PHOTOGRAPH RELEASE

All students who agree to these terms and conditions attest to the acknowledgement,  competency and agreement to the following video and photograph release:

I hereby grant NAPTP, LLC (the “Institution”) the irrevocable right and permission to use  photographs and/or video recordings of me on Institution and other websites and in  publications, promotional flyers, educational materials, derivative works, or for any other  similar purpose without compensation to me.

I understand and agree that such photographs and/or video recordings of me may be  placed on the Internet. I also understand and agree that I may be identified by name  and/or title in printed, Internet or broadcast information that might accompany the  photographs and/or video recordings of me. I waive the right to approve the final  product. I agree that all such portraits, pictures, photographs, video and audio  recordings, and any reproductions thereof, and all plates, negatives, recording tape and  digital files are and shall remain the property of the Institution.

I hereby release, acquit and forever discharge the Institution, its current and former  trustees, agents, officers and employees of the above-named entities from any and all  claims, demands, rights, promises, damages and liabilities arising out of or in  connection with the use or distribution of said photographs and/or video recordings,  including but not limited to any claims for invasion of privacy, appropriation of likeness  or defamation.

I hereby warrant that I am eighteen (18) years old or more and competent to contract in  my own name or, if I am less than eighteen years old, that my parent or guardian has  read and agreed to these terms on my behalf. This release is binding on me and my  heirs, assigns and personal representatives.

No warranties

This website is provided “as is,” with all faults, and NAPTP express no representations  or warranties, of any kind related to this website or the materials contained on this  website. Also, nothing contained on this website shall be interpreted as advising you.

Limitation of Liability

In no event shall NAPTP, nor any of its officers, directors and employees, be held liable  for anything arising out of or in any way connected with your use of this website  whether such liability is under contract. NAPTP, including its officers, directors and  employees shall not be held liable for any indirect, consequential or special liability  arising out of or in any way related to your use of this website.

Indemnification

You hereby indemnify to the fullest extent NAPTP from and against any and/or all  liabilities, costs, demands, causes of action, damages and expenses arising in any way  related to your breach of any of the provisions of these Terms.

Severability

If any provision of these Terms is found to be invalid under any applicable law, such  provisions shall be deleted without affecting the remaining provisions herein.

Variation of Terms

NAPTP is permitted to revise these Terms at any time as it sees fit, and by using this  website you are expected to review these Terms on a regular basis.

Assignment

NAPTP is allowed to assign, transfer, and subcontract its rights and/or obligations  under these Terms without any notification. However, you are not allowed to assign,  transfer, or subcontract any of your rights and/or obligations under these Terms.

Entire Agreement

These Terms constitute the entire agreement between NAPTP and you in relation to  your use of this website and supersede all prior agreements and understandings.

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the  State of Michigan, and you submit to the non-exclusive jurisdiction of the state and  federal courts located in Michigan for the resolution of any disputes.
